I felt it is 'have been', because the action started in the past and still continutes, but the answer key shows 'are', why?

I think it's a poor question. Both "are" and "have been" are grammatically possible. Perhaps it could be argued that "are" is a better fit for some subtle reason, but it's not clear-cut enough to be an either/or choice.
